Terms of use

1. Introduction

Slowby is a social enterprise with the mission of making slow travel more accessible, currently in the process of being registered and subject to the Belgian law. These Terms of Service ("Terms") apply to your access to and use of the website and the use of the self-planning tool (collectively, our "Platform") provided by Slowby.

The use of this platform is subject to a number of rules. Below you can find the general conditions of our platform, as we are convinced that clear rules provide the best guarantee for a respectful community. By using any kind of service provided by Slowby, you automatically agree to these Terms. 

Because Slowby appreciates the feedback of the users of its platform, we welcome any ideas to further improve it. You can email your suggestions to hello@slowby.travel.

2. Trips

Steps to create a secret trip

1. Planning tool

‍Travellers plan their trip by using the Slowby planning tool, minimum 5 days before their first travel date. The travellers are solely responsible for the information provided in the planning tool. Once filled in, the planning tool information cannot be amended. 

2. Who can plan a trip

‍Travellers need to be above 18 years old to plan a trip with Slowby. Travellers less than 18 years old must always travel with adults, except if travellers present an official authorization signed by their tutor. Any request has to be sent to trips@slowby.travel.

3. What is included ‍
  • Day-to-day secret travel plan: Your trip is secret. You receive your first travel plan 3 days before you leave. Once you're on the road, you'll get your travel plan for the next day in the evening. Exciting!
  • Handpicked points of interest along your way: With the help of our slow travel experience and open data, we find the best routes and new places for you to discover.
  • Camp in the garden of an experienced host: With our fantastic ambassadors of Welcome To My Garden, we arrange a nice and safe spot for you to camp for the night.

    ‍Contribute to regenerative tourism: With your trip, you create a positive impact on local communities and economies around you. For each stay in a garden, a €5 donation (included in the price) goes to a positive impact initiative chosen by the Welcome To My Garden ambassadors.
  • Advice and support from experienced slow travellers: Our checklist makes it easy for you to pack. In case you need anything, we're here to help! During your trip, you can always reach us via WhatsApp to ask a question or just share your excitement!
4. What is not included
  • Slow travellers need to take care of their own equipment which includes their bicycle, cycle equipment and all camping equipment.
  • Train tickets: from their railway station, travellers choose to either directly start cycling or first take the train. If they take the train, they buy their train tickets directly at the station.

Rules to stay with a WTMG ambassador

With the ambassadors of Welcome To My Garden, a not-for-profit network of citizens offering free camping spots to slow travellers, Slowby arranges a basic and safe spot for the night. By using Slowby, travellers therefore also automatically agree to the Terms of Use of Welcome To My Garden including, but non exhaustively:

1. WTMG ambassadors are citizens, not service providers

WTMG ambassador are citizens putting their garden freely at disposal for slow travellers to spend the nights. They are not service providers. 

2. Facilities

WTMG ambassador put their garden at disposal for travellers to spend the night. Facilities may vary from one garden to another. Some ambassadors might offer access to showers, others not. Travellers will always have access to toilets (inside or outside). Travellers will be informed in advance of the available facilities.

3. Respect for Nature 

Respect For Nature: users have to take all their waste away upon leaving. Travellers should always respect nature, the ambassador's garden and their surroundings, and adhere to the Leave No Trace principle.

4. Respect for the ambassador and the neighbours

Travellers should always be respectful of the garden owners and reduce noise to a minimum. They should also stick by any requirements the ambassadors have made.

5. Disclaimer

‍Slowby will not take any responsibility for any loss, damage or injury incurred as a result of staying in an ambassador's garden.

6. Communication

‍On the day of arrival, travellers should send a message or call the WTMG ambassador and provide the information on the estimated time of arrival. Slowby will provide the telephone number of the travellers to the ambassador and vice versa. This private information cannot be disclosed by both parties to any external parties.

Cancellations and Refunds

Cancellation by the traveller 

Overall, cancellations must be sent to trips@slowby.travel mentioning your full name. The date on the email will be effective for this cancellation. Refunds are made within 1 month on payment method used at checkout.

Up to 30 days before first travel day

Between 30-7 days before first travel day

Cancellable: Yes | Refund: Yes, except for a single fixed fee of €35

Less than 7 days before first travel day and during the trip

Cancellable: No | Refund: No

Cancellation by Slowby
Unavailability of WTMG ambassadors

In the case of the unavailability of WTMG ambassadors, Slowby reserves the right to postpone the trip or to offer alternatives for the travellers. Slowby will contact the travellers to find a new suitable date. In case the traveller doesn’t have any other availability, the traveller will be entitled to a full refund within 1 month. 

Extreme weather conditions ("Major Force")

In the case of extreme weather that might be unsafe for travellers, Slowby reserves the right to postpone the trip. As Slowby is not responsible for this cancellation, the travellers will be offered to choose a new suitable date or a voucher to replan a trip within the next 12 months.

Payment

Trips are confirmed as soon as the payment has been received by Slowby. Slowby accepts digital payment methods such as Credit/Debit card and Bancontact. Travellers receive a payment link in the following days after the trip has been confirmed. Full payments should take place maximum 5 days after receiving the bancontact email. In case a payment is not fully received 5 days before the first travel date, Slowby reserves the right to cancel the trip. All prices published on the Slowby website are expressed in euro & include VAT. All refunds, when applicable, take place within 1 month after the first travel date.

Memberships

Membership under construction

At the date of the last modification on these terms, memberships are not available as standalone products. They can only be acquired through planning a first trip (first 1.000 trips only). These terms will be modified when the membership becomes available by itself.

Definition of the membership

The membership - which is currently under construction and will be further developed in 2022 - includes the following points: 

  • Meet, ask your questions and hear stories from other travellers and WTMG ambassadors.
  • Receive a curated list of slow travel ideas, inspiration and events.
  • Early access to new slow travel tools that Slowby is going to build.
Limitation of liability

The limitations of liability (see below) of Slowby in general also apply for the use of the membership, which means that Slowby cannot be held responsible for any damages or loss that would occur during a trip inspired or planned with the membership. Please refer to the full section “Limitation of liability” below.

Limitations to content and use of the membership

The limitation to content and use of the platform for Slowby applies to the membership. Please refer to the section “Limitations to content and use of the platform” for more information. Overall, the creation of an account by a traveler does not give this user ownership over the account. Slowby reserves the right to refuse, suspend or delete accounts, for example if the user does not comply with the following rules or inappropriate behaviour has been reported by the ambassador or guest.

4. Limitations to content and use of the platform

To ensure that the Slowby platform is working properly and that you can communicate and connect with others, there are some restrictions to the type of content that can be published via the platform, including the community platform. These are as follows:

Offensive behaviour

We firmly believe in freedom of speech. However, in order to ensure that the platform can be used in a constructive way by all users and travellers, we do not allow offensive behaviour that constitutes harassment, intimidation or fear-mongering. Accounts and related accounts that are used to perform the actions listed below can be temporarily blocked and / or permanently deleted.

Violent threats (direct or indirect): You may not threaten or promote violence. This includes the promotion of terrorism.

Harassment: You may not incite to or be involved in deliberately insulting or harassing others. Here are some factors that we can take into account when assessing abusive behaviour: whether the main purpose of the reported account is harassing or sending offensive messages to others; whether the reported behaviour is unidirectional or contains threats; whether the reported account encourages others to intimidate another account; and whether the reported account sends intimidating messages to an account from multiple accounts.

Hatred: You may not promote violence against other people or directly attack or threaten them on the basis of race, ethnic background, nationality, sexual orientation, gender, gender identity, philosophical affiliation, religion, age, disability or illness. We also do not allow accounts whose main purpose is to incite others to do harm on the basis of these categories. Misuse of multiple accounts: Creating multiple accounts for overlapping use to avoid temporary or permanent suspension of an individual account is not allowed.

Private data: You may not publish or post confidential data and private information of others without their express authorization and consent. These data include but are not limited to: credit card numbers, address details, telephone numbers or data that fall under the personal privacy of a person. Impersonation: You are not allowed to access the platform pretending to be someone else and specifically you may not deceive, confuse or threaten other users in this way. You may not be allowed to enter via the platform if someone else deceives, confuses or threatens in a manner that actually decks or threatens others.

Indemnity

You shall defend, indemnify and hold harmless Slowby.travel (and each of its funders and/or volunteers) from any claim, demand, action, damage, loss, cost or expense, including without limitation reasonable attorneys’ fees, arising out or relating to (a) your use of our services; (b) any member content or submissions you provide; (c) your violation of these terms; (d) your violation of any rights of another; or (e) your conduct in connection with the services. Further, if you are using the services on behalf of any entity, you represent and warrant that such entity agrees to indemnify you and Slowby.travel for violations of these terms in accordance with this section. If you are obligated to indemnify us, we will have the right, in our sole and unfettered discretion, to control any action or proceeding and determine whether we wish to settle it, and if so, on what terms.

Travellers agree not to use the membership nor the community platform for:

- For any unlawful purposes; To upload, post, or otherwise transfer any material that is offensive, unlawful, threatening, abusive, harmful, an invasion of privacy, defamatory, discriminatory; To upload, post or otherwise transfer any material that violates copyright, trade mark, patent or other intellectual property right and moral right of a third party; For any commercial purpose; To sell access to the membership or trips on any other website;

5. Limitation of liability 

Slowby - including its founders, advisors, board members, employees and potential freelancers - will not be liable to either travellers and/or ambassadors under any theory of liability—whether based in contract, tort, negligence, strict liability, warranty, or otherwise—for any indirect, consequential, exemplary, incidental, punitive or special damages. The platform cannot be held responsible for any failure or delay in performing the terms. The platform cannot be held responsible for any liability in case of personal injury or death resulting from using it. Travellers must follow the local traffic regulations.

IN NO EVENT SHALL SLOWBY, A BELGIAN SOCIAL ENTREPRISE, OR ITS FUNDERS AND EMPLOYEES, INDIRECT OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO LOSS OF USE, LOSS OF PROFITS OR LOSS OF DATA, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE) OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, ARISING FROM OR RELATING TO: (A) THE USE OR INABILITY TO USE OUR SERVICES; (B) THE COST OF REPLACEMENT OF ANY GOODS, SERVICES OR INFORMATION PURCHASED OR OBTAINED AS A RESULT OF ANY INFORMATION OBTAINED FROM OR TRANSACTIONS ENTERED INTO THROUGH OR FROM OUR SERVICES; (C) DISCLOSURE OF, UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR CONTENT; (D) DAMAGES FOR LOSS OR CORRUPTION OF DATA OR PROGRAMS, SERVICE INTERRUPTIONS OR PROCUREMENT OF SUBSTITUTE SERVICES, EVEN IF WE KNOW OR HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; (E) STATEMENTS, CONDUCT OR OMISSIONS OF ANY SERVICE PROVIDERS OR OTHER THIRD PARTY ON OUR SERVICES; (F) YOUR OR ANYONE ELSE’S CONDUCT OR ACTS IN CONNECTION WITH THE USE OF THE SERVICES, INCLUDING WITHOUT LIMITATION, BODILY INJURY, EMOTIONAL DISTRESS, DEATH OR ANY OTHER DAMAGES RESULTING FROM COMMUNICATIONS OR MEETINGS WITH OTHER REGISTERED MEMBERS OF OUR SERVICES OR PERSONS INTRODUCED TO YOU BY OUR SERVICES, WHETHER ON-LINE OR OFF-LINE; OR (G) ANY OTHER MATTER ARISING FROM, RELATING TO OR CONNECTED WITH OUR SERVICES OR THESE TERMS.

6. Technical abuse and spam

Slowby strives at all times to protect its platform users from technical abuse and spam. Accounts that are used to perform the actions listed below can be temporarily blocked or permanently deleted. Malware / phishing / viruses / worms / Trojans: You may not post malicious content or links to such content for the purpose of damaging or disrupting someone else's browsers or computers, or of violating someone's privacy. 

7. Infringement of applicable laws

The use of the account may not in any way infringe applicable laws. This includes infringements against privacy legislation, intellectual property rights, the criminal code, etc. The account may not be used to promote illegal activities in any way.

8. In case of breaches of the aforementioned rules

Slowby reserves the right to delete the relevant messages on the community platform if it detects infringements of the aforementioned rules, and may even suspend or permanently delete user accounts. Slowby cannot be held liable in any way for messages posted by users or third parties, which violate the rules specified above. If a user detects an infringement, please report this to the following email address: . It may occur that harmful files can be downloaded via the platform, whether or not due to a user, or that users place harmful hyperlinks. Every download by a user or click on a hyperlink, placed by a user, is done at the user’s own risk. Any damage incurred is completely and solely the responsibility of this user.

9. Property rights Slowby

The tools and content created by Slowby belongs to Slowby. The visual identity, including the logo and colors, and the name cannot be used nor replicated for any other platform without the prior permission of Slowby.

10. Intellectual property rights

Slowby respects the intellectual property rights of others and expects that users of this platform also respect these rights. Slowby reserves the right to remove content that infringes intellectual property rights. Repeated infringements of intellectual property rights of any kind by a user will result in the suspension or removal of the account by Slowby. 11. Changes to these Terms

We may make changes to these Terms from time to time. If we make changes, we will post the amended Terms to our Platform and update the 'Last Updated' date above. We may also attempt to notify you by sending an email notification to the address associated with your account or give notice through our Platform. Unless specified otherwise in our notice, the amended Terms will be effective immediately and your continued access to and use of our Platform after we give notice will confirm your acceptance of the changes. In any case, changes to these Terms will not be retroactive. If you do not agree to the amended Terms, you must stop accessing and using our Platform.
